Title: Are we screwed?
Description: Court Limits Suits Over Medical Devices

Guess that means if my VNS explodes :Bomb: in my chest I am S.O.L. ??

Thank you Supreme Court :usflag:

It talks about state lawsuits. Perhaps a Federal lawsuit is more appropriate?

That is provided of course, you even GET to court. Lawyers are too leary to take on CYBX from what other patients tell me.

Yes Tincatt, we are all S.O.L. Below is an excerpt from an e-mail I received from my attorney.

And yes, the recent Supreme Court rulings does mean that if a product was negligently designed or that the warnings associated with the product omit important information AND the company rec'd a 510K approval you cannot sue them for negligent design or failure to warn the public. Yes, it means Cyberonics can kill people and get away with it. Yes, it is really stupid law and the Supreme Court is packed with corrupt corporate stooges. This is why I called you when the medtronic case was announced. It is revolutionary in its impact and completely wrong in its logic.

I hope that this doesn't offend anyone here that isn't Christian (this is MY opinion) but what those smart alecks at Cyberonics and those people that made that law don't remember is that one day they will have to stand before God Himself and explain why they did what they did to so many innocent people. That will our day in court.

Amen sister!

And I second that AMEN!

Now you know why all those politicians are given such special treatments and contributions. To create laws to cover their asses.

But just because they made this law, doesn't mean it can't be changed!

>20,000 of these units are TURNED OFF. It's safe to assume at least HALF of those were some serious side effects. And no telling how many suspicious deaths! Corporations can silence one voice. They can bully small bands of people into submission, but when MANY voices cry out, they ARE heard.
